Terms of service

The rules for using OpenPromote and EmailCurator, in plain words. Please read them before you buy or send.

In short

  • You must be 18 or over, and you're responsible for what you send.
  • Only email people who agreed to hear from you or know you. No spam, scams or bought lists.
  • One credit writes one email. Credits never expire, and they can't be swapped for money except under our refund policy.
  • The AI can make mistakes: read every email before you send it.
  • Your words and lists stay yours. We use them only to run the service for you.

About these terms

OpenPromote (“we”, “us”) runs the website at openpromote.org and its tools, starting with EmailCurator. These terms are the agreement between you and us when you use the website or its tools. By creating an account or using the service, you agree to them.

If you use OpenPromote for a business, you agree to these terms for that business too. Our Privacy policy and Refund policy are part of these terms.

Your account

  • You must be 18 or over to create an account.
  • Use your real name and an email address that is yours.
  • Your sign-in codes go to your email, so keep your email account safe. You’re responsible for what is done in your OpenPromote account.
  • Tell us straight away if you think someone else has used your account.

What OpenPromote does

EmailCurator writes emails from the details you give it, using AI, and checks them before you see them. You can copy an email, open it in your mail app, or send it to your list from your own email account.

We can’t promise how people will respond to your emails, or that every email will be delivered: that depends on your email provider, the people you write to and their providers.

Credits and packages

  • You buy packages of credits with a one-time payment. There is no subscription.
  • One credit writes one new email, of any kind. Each email includes up to 3 free changes: a refine or a fresh version. Your own edits are always free.
  • Each email can reach as many people as your package allows, counted across all its sends. One more credit adds the same number of people again.
  • If writing an email fails, its credit goes back to your account automatically.
  • Credits don’t expire. A new package adds to the credits you have.
  • Credits have no cash value, and can’t be sold or moved to another account. They are refunded only as the Refund policy says.
  • We may change our prices. Credits you already have keep working as before.

Payments

  • Prices are shown before you pay. Card payments are in US dollars; JazzCash, EasyPaisa and bank transfers are in rupees.
  • Card payments are handled by Payoneer, under its own terms. We never see your card details.
  • For JazzCash, EasyPaisa and bank transfers, we check the payment before adding your credits. Giving false payment details can get an account closed.

Who you may email, and how

You may send emails only to people who:

  • agreed to hear from you, or
  • have a real connection with you that makes your email expected, such as your customers, members, students or business contacts.

In every email you send:

  • make clear who it is from;
  • tell people how to stop getting your emails, and stop emailing anyone who asks, quickly;
  • follow the laws that apply to you and to the people you write to, such as Pakistan’s Prevention of Electronic Crimes Act 2016 and the anti-spam laws of their countries.

You must not use OpenPromote for:

  • spam, or lists you bought, rented, scraped or collected without permission;
  • phishing, scams, fake offers, or pretending to be someone else;
  • anything illegal, or that helps someone break the law;
  • harassment, threats, or hate against anyone;
  • sexual content, or anything that harms children;
  • viruses, malware or harmful links;
  • false or misleading claims, such as fake health cures or money-making schemes.

You also must not try to break, overload or get around how the service works, copy it, or use bots to access it, except where we allow it.

Sending from your own email account

Your emails go out from your own email account, so you must be allowed to use that account, and follow your email provider’s rules (for example, Gmail’s).

To protect your account, we send at about 12 emails a minute and at most 500 a day from one account. Don’t try to get around these limits. Your email provider can still limit or close your account if it decides to; we can’t control that and aren’t responsible for it.

Your content

What you put in (your details, your lists, your files) and the emails written for you stay yours. You may use the emails however you like.

You allow us to store and process your content only to run the service for you, including sending the details you give to our AI provider to write your emails. We look at your content only when you ask for help, or when we must for security or by law.

You’re responsible for your content, and for having the right to use everything you send, such as logos and attachments.

AI can make mistakes

Emails are written by AI. Our checks catch many problems, such as facts that weren’t in your details, placeholders and spam words, but not all of them. Read every email before you send it. You decide what you send, and you’re responsible for it.

Changes to the service

We keep improving OpenPromote, so features can change, be added or be removed. We work to keep it running, but can’t promise it will always be available or free of faults. If we ever stop offering EmailCurator, we’ll tell you at least 30 days before.

Closing or suspending an account

You can stop using OpenPromote at any time, and ask us to delete your account.

We may suspend or close an account, and stop its sends, if it breaks these terms: for example, after spam complaints, fraud or false payment details. Unused credits of an account closed for breaking these terms are not refunded. If we close your account for any other reason, we refund your unused credits.

What we're responsible for

We provide OpenPromote “as is”. As far as the law allows, we aren’t responsible for indirect losses, such as lost sales, profits, data or reputation, or an email provider limiting your account.

As far as the law allows, the most we are responsible for, in total, is what you paid us in the 12 months before the problem. Nothing in these terms limits a responsibility that the law doesn’t allow us to limit.

If someone makes a claim against us because of emails you sent, or because you broke these terms, you agree to cover our reasonable costs.

Changes to these terms

If we change these terms, we change the date at the top of this page. For important changes, we email you or tell you on the website before they apply. If you keep using OpenPromote after that, you accept the new terms.

The law that applies

These terms are governed by the laws of Pakistan, and disputes go to the courts of Pakistan. Before going to court, please talk to us: most problems can be sorted out quickly.
